Terms of Service

These terms govern your use of Janus. Installing the app means you accept them. If you are accepting on behalf of a company, you confirm you are allowed to bind it.

1. What Janus is

Janus is a Shopify app for building and running on-site popups: email and SMS capture, quizzes, games, multi-step flows, discount rewards, and reporting on what those popups produced. We may add, change, or remove features as the product develops.

2. Eligibility and accounts

You need an active Shopify store to use Janus, and you must be old enough to enter a contract where you live. You are responsible for what happens under your account, including anything done by staff you give access to.

3. Your responsibilities as a merchant

Janus puts forms on your storefront and collects data from your shoppers. That makes some obligations yours, not ours:

• Consent and marketing law. You are responsible for complying with the rules that apply to you — GDPR, UK GDPR, CAN-SPAM, CASL, TCPA, and any local equivalent. Janus records consent and its wording; choosing lawful wording is your call.
• Your own privacy policy. You must tell your shoppers what you collect and why. Our Privacy Policy describes our part; it does not replace yours.
• Your content. Text, images, and offers you put in a popup must be yours to use and must not be unlawful, deceptive, or infringing.
• Your offers. Discounts a popup issues are real discounts on your store. You are responsible for them being correct and honoured.

4. Acceptable use

Do not use Janus to send unsolicited marketing, to collect data deceptively, to impersonate anyone, to break the law, or to attack, overload, or reverse engineer the service. Do not resell Janus as your own product without a written agreement with us.

5. Fees and billing

Janus offers a free tier and paid plans. All charges are handled by Shopify, billed through your Shopify account, and shown to you for approval before they apply. We never take payment details directly.

You can change or cancel a plan from your Shopify admin. Shopify's rules govern the timing of charges and any refunds. Uninstalling the app cancels the subscription going forward; it does not automatically refund a period already charged.

6. Your data

Store and shopper data you put into Janus stays yours. You grant us the licence needed to run the service — to store, process, and transmit that data on your instructions, including to the email or SMS tools you connect. Details are in the Privacy Policy.

We may use aggregated, de-identified statistics to improve Janus. This never identifies a store, a shopper, or an individual.

7. Our intellectual property

Janus, its software, its designs, and its name remain ours. The popups you create with it are yours. Nothing here transfers ownership of our software to you, or of your content to us.

8. Availability

We aim to keep Janus running and to fix problems quickly, but we do not promise uninterrupted or error-free service. Maintenance, provider outages, and Shopify platform changes can all cause downtime. We are not offering a service level guarantee at this stage, and we will not pretend otherwise.

9. Disclaimer

Janus is provided "as is" and "as available". To the fullest extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee any particular conversion rate, revenue, or business result.

10. Limitation of liability

To the fullest extent the law allows, Janus Inc. is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim relating to the service is limited to the amount you paid us for Janus in the twelve months before the claim arose.

Some jurisdictions do not allow these limits. Where that is so, they apply only as far as the law permits.

11. Indemnity

You agree to cover us against claims arising from your content, your offers, your use of the service, or your failure to meet the responsibilities in section 3.

12. Suspension and termination

You may stop at any time by uninstalling Janus from your Shopify admin. We may suspend or end access if these terms are breached, if use of the service puts other merchants or shoppers at risk, or if we are legally required to. Where circumstances allow, we will tell you first.

After uninstall, your data is erased as described in the Privacy Policy. Export anything you want to keep before you uninstall.

13. Changes to these terms

We may update these terms. Material changes will be notified in the app or by email, and the date at the top will change. Continuing to use Janus after that means accepting the new terms.

14. Governing law

These terms are governed by the laws of the jurisdiction in which Janus Inc. is incorporated, without regard to conflict of law rules. Disputes will be handled by the courts of that jurisdiction.
